Protocol for discovery:
1. No means No.
If any putative class members contacted by plaintiffs counsel/Investigator or by Apple management and putative class member says he does not want to speak about the case, any further questioning must cease. Apple must also inform employee to who it wishes to contact concerning this case that no adverse action will be taken against employee for participation in the class and that employee does not have to speak about the case if employee does not wish to.
2. All documents already provided to plaintiff counsel by putative class members are subject to protective order and do not have to be returned. Prospectively any documents plaintiff wishes to use must be requested through Apple’s counsel and will be provide on expedited basis within 10 days. Plaintiff counsel must be carefully targeted and economical if not parsimonious in these requests.
Motion to Certify Class – goal: complete PMQs in January, all cleanup discovery in February. Plaintiff will file motion to certify class 3/22/13

Plaintiff will withdraw request for Mr. Jafri to produce for deposition, but Apple will produce documents 10 days. Parties will cooperate to expedite rescheduling of Jafri deposition after plaintiff receives records.
