Exhibits B & C will be deemed lodged conditionally under seal and after this ex parte will be returned to the plaintiff.
Court understands of 15 Apple employees who have had an issue similar to those giving rise to this case, 2 have opted out per Bellaire notice i.e. have requested this contact information not be provided. Nevertheless since there is reason to believe each may be a potential witness to specific alleged acts of misconduct, the Court requires Apple to produce contact information for these 2 individuals. The Court also requires that counsel agree on wording for a letter to these two individuals to be delivered simultaneously with release of contact information stating (1) Court and parties recognize each has requested not to be contacted; (2) nevertheless the Court has determined that each may be a witness to incidents which may be similar to those giving rise to this case; and (3) for that reason the Court has required Apple to release their contact information and (4) they may be contacted by counsel for plaintiff seeking information about possible similar incidents.
Apple to draft letter which will so state, and plaintiff is to approve as to form by 6/7/13.
