Jan 09, 2013 Minute Order re Motion to Compel Production of Documents

 

Counsel before the Court ex parte on Plaintiffs application to compel production of documents.

Counsel agree that the Court may resolve this discovery dispute informally at ex parte. NPP is currently taking a survey of Apple employees and is not focused in wage and hour waiting time issues. However, any data base can be searched for key words.

Apple will meet and confer with computer expert to determine how Apple will respond to request for production of documents from NPP Date Source to conditionally provide all information which relates to meal break, waiting time allocation and illegal pay check. (See Labor Code § 212) Apple computer expert is to provide declarations as to how this was done. Compliance by 1/29/13.
