Court has required telephonic communication before any ex parte but is not convinced that the requirement of personal communication in persona or by telephone was followed with respect to these disputes.

Bates labeling issue — re: request no. 1, 2 + 3
Apple contends that these responses are sufficient.
Apple states where there are a series of dates regarding a policy – if responses are arranged chronologically earliest date is in effect until next earliest date, etc.
Given that explanation these responses are satisfactory.

Re: attempt to depose Mr. Cook, plaintiff’s request is sorely lacking since plaintiff has not even begun to exhaust other means of learning this information before Mr. Cook’s Apex deposition.

Motion to Certify has 3/22/13 filing deadline.
Fining deadline date is extended to 5/7/13
Opposition 6/14/13
Reply 7/3/13
Ruling 7/24/13 at 10:00 am.

Parties are reminded that discovery is to focus on class certification issues.
All further meet and confers must include telephonic communication.
If there is any further ex parte on Apex, 72 hours notice on opposition should be 24 hours in advance.

Leave is granted to file 2nd Amended Complaint after telephonic meet and confer if there is no objection.
If there is an objection, parties should re ex parte.
Draft of Amended Complaint should have changes in italics or underlining or red line.

Motion Hearing to Certify/Decertify Class Action is continued pursuant to Court’s motion to 07/24/2013 at 10:00AM before Judge Ronald S. Prager.
