The Court hears oral argument re: Plaintiffs’ Ex Parte Request to (1) Clarify July 27th Minute Order re: Corporate Schedules and (2) Discuss fifty-four Class Members that Signed Release & Stipulations.

The Court hears oral argument re: Defendant’s Ex Parte to Demand Plaintiff to Produce Contact Information.

The Court makes the following rulings:

Plaintiff shall unconditionally dismiss fifty-four plaintiffs who fail to respond to counsel’s attempts to contact them, or be prepared to go to trial with these individual claims.

Defendant shall send to plaintiff the list of the five remaining names out of the original forty-six that remain troublesome.

Plaintiff shall contact SSRS regarding the original/underlying documents in the drop box and daily logs and whether these documents remain available to review. A declaration shall be submitted as to whether SSRS has the documents listed in Mr. Boyer’s email sent on Monday, August 8, 2016, as exhibit A.

Defendant shall file and serve a rebuttal by August 24, 2016.

The Court denies the request for a reciprocal report, as it was not before the court.
The deposition of Dr. Krosnick will not be going forward today. Plaintiffs’ request for sanctions is denied.
